Today, we announce our appeal against the recent ruling of Justice Bromwich in the Federal Court of Australia that misinterprets the fundamental rights of women and girls, and the principles of single-sex spaces essential for their safety and dignity. This case underscores a critical conversation about gender identity and the necessity of protecting the rights of both sexes in our society. Our appeal challenges a declaratory judgment that wrongfully finds our actions constituted “unlawful indirect discrimination” based on gender identity. We assert that the ruling erred in several key areas: 1. The court misinterpreted the legal definition of “sex” under the Sex Discrimination Act 1984 (Cth), expanding it beyond biological realities, which could undermine protections meant for women and girls. 2. The judgment failed to recognise that our platform, the Giggle App, serves as a ‘special measure’ aimed at fostering equality between men and women, rather than promoting discrimination. By providing a dedicated space for women, we are not just protecting their rights but championing the values of fairness and safety for all. 3. Critical evidence was not considered, denying us the opportunity to present a comprehensive view of the implications of this ruling on society. As we move forward with our appeal, we emphasise that women standing up for their rights, including the right to single-sex spaces, are acting with bravery, honesty, and integrity. This is not an act of unkindness or bigotry; rather, it is a stand for fairness, honesty and truth, acknowledging the unique experiences and challenges faced by women and girls. Our commitment is to ensure that discussions surrounding gender identity and rights do not come at the expense of women’s safety and dignity. We believe in a society where all voices are heard, and where protecting the rights of one group does not diminish the rights of another.
